National Labor Day: Compensation Rules for Employees Who Work

Bangkok: On National Labor Day, celebrated annually on May 1, employees are entitled to a day off with normal pay, while those who work are eligible for increased compensation. Businesses that remain operational on this holiday must either provide a different day off or compensate employees accordingly.

According to Thai News Agency, Ms. Lalida Periswiwatana, Deputy Spokesperson for the Prime Minister's Office, stated that employees required to work on National Labor Day must be compensated with at least double their normal wages. For any overtime work on this day, the law mandates that employers pay at least three times the usual hourly rate.

National Labor Day is legally recognized, ensuring employees receive fair treatment and protection of their rights. In cases where the holiday falls on a weekend, the Department of Labor Protection and Welfare mandates employers to grant a compensatory day off on the next working day.

For businesses in sectors such as hospitality, healthcare, and transportation, where ceasing operations may not be feasible, employers can arrange alternative days off with employees or opt to pay them for working on the holiday. This flexibility ensures that employees' legal rights are respected while accommodating essential services.
