Bangkok: Pediatricians emphasize that the Child Protection Act states that guardians are responsible if they neglect their children and allow them to cause serious harm, even if the child has special needs. Dr. Suriyadev Tripathi, a pediatrician specializing in children and adolescents and director of the Center for Moral Development (Public Organization), commented on the incident where an 11-year-old child drove a car that killed a monk and injured others, on his Facebook page "Dr. Dev's Notes." He stated that the child was definitely at fault, even if they were a child with special needs. He emphasized that the legal process will follow, and child protection will be provided according to the Convention on the Rights of the Child and the standards of multidisciplinary professionals. Regarding the claim that the child in question has special needs, he stressed that this must be determined by a pediatrician or psychiatrist.
According to Thai News Agency, Dr. Suriyadev noted that there are many types of special needs children, including autism, various disabilities, and intellectual disabilities, among others. He reiterated that a diagnosis must be made by a doctor according to established procedures, and close supervision from parents is also crucial. The Child Protection Act includes a section on the legal duties of guardians in caring for children. If neglect results in violence or harm, the guardians are held responsible. There is a call for an agency to be responsible for overseeing those who suffer harm, such as the Ministry of Social Development and Human Security or the Office of the Attorney General for Rights Protection, etc.
Dr. Suriyadev also stated that children who committed violent crimes resulting in numerous deaths, after recovering from their illnesses, should report their community service activities monthly for life, with the Department of Probation monitoring these reports.
