Royal Decree Draft to Enhance Social Security Benefits for Freelancers Moves Forward

Bangkok: The government is advancing the drafting of the Royal Decree on the Development of Social Security Benefits under Section 40, aiming to enhance benefits for self-employed individuals. Prime Minister’s Office Spokesperson Siripong Angkasakulkiat disclosed that this initiative, led by Prime Minister and Minister of Interior Anutin Charnvirakul, underscores the administration’s commitment to enacting legislation that supports the labor sector, crucial for the Thai economy.

According to Thai News Agency, the Social Security Office (SSO) plans to extend social security coverage to 20 million freelance workers across Thailand. By August 2025, over 11,018,243 individuals had shown interest in Section 40 coverage. Freelance workers have the option to apply for coverage or make contributions based on their preference.

The draft Royal Decree outlines new criteria and rates for contributions, types of benefits, and conditions for receiving benefits. This amendment aligns with current economic and social conditions, replacing the criteria set in B.E. 2561. Key points include a reduction in the compensation period for accidents or illnesses, increased outpatient payment rates, and retroactive compensation for those affected by COVID-19.

The decree also proposes lifelong monthly disability compensation, child support amendments, and criteria for old age benefits. Temporary provisions allow those injured or sick before enforcement to receive compensation under new criteria.

The Cabinet approved the draft in principle on June 4, 2025. It is currently under review by the Council of State, after which it will be submitted to the Social Security Office and subsequently to the Cabinet Secretariat for final approval and publication.

Individuals eligible for Social Security under Section 40, including freelancers, informal workers, and persons with disabilities, will receive coverage for various welfare benefits. They can apply in person or through multiple digital platforms provided by the Social Security Office and the Ministry of Labor.
