“Ruangkrai” urges NACC to send “Settha” case to the Supreme Court for consideration

"Ruangkrai" petitions the NACC to copy a copy of the Constitutional Court's ruling ordering "Settha" to resign as Prime Minister, expedite the preparation of the case to send to the Supreme Court for a ruling on ethical violations. Lawyer Ruangkrai Leekijwattana sent a letter to the NACC by post, asking it to expedite the submission of the case to the Supreme Court for consideration and ruling on whether the Constitutional Court's ruling on August 14 would cause Prime Minister Settha Thavisin to seriously violate or fail to comply with ethical standards under Section 234 (1) of the Constitution. The letter attached the Constitutional Court's ruling, which ruled that Settha's ministerial status had ended under Section 170, Paragraph 1 (4) of the Constitution, due to his apparent lack of honesty and integrity, lack of qualifications under Section 160 (4), and his behavior in a manner that seriously violates or fails to comply with ethical standards, which is prohibited under Section 160 (5). When the Prime Mi nister's status as a minister ends in accordance with Section 170, paragraph one (4) of the Constitution, the Minister must leave his position in the Cabinet in accordance with Section 167, paragraph one (1) of the Constitution, and Section 168, paragraph one (1) shall apply to the performance of duties of the Cabinet that has left its position. Mr. Ruangkrai said that the result of the Constitutional Court's decision, which is final, is binding on the NACC. Therefore, it is necessary to ask the NACC to copy the Constitutional Court's decision along with the documents to be used as the NACC's investigation report to submit the matter to the Supreme Court for further consideration. The petition filed by Mr. Settha to the NACC was filed because if the Supreme Court later ruled in accordance with the Constitutional Court, his voting rights would be revoked forever. In line with the Constitutional Court's ruling, there are many other ministers whose behavior is considered to be in breach of ethics and the facts are currently being collected and forwarded to the NACC for further action. Mr. Ruangkrai also revealed that today at 1:00 PM he will give a statement to the Election Commission in the petition submitted for the Election Commission to investigate whether two ministers hold shares exceeding 5 percent or not. If the verdict is as alleged, there will be a two-year lapse according to Section 160 (8). Even though the cabinet is the result of the entire group, this case cannot be dropped.
