“Srisuwan” petitions NACC to investigate political parties for submitting amendments to ethics in the constitution, whether it constitutes a conflict of interest or not.

Mr. Srisuwan Janya, leader of the organization Love the Nation, Love the Country, has traveled to submit a petition to the NACC to investigate and rule on the case of members of the House of Representatives and/or political parties who have submitted a request to amend the constitution, section by section, by amending the power of the NACC and the power of the Constitutional Court to examine the ethics of politicians. Is it a conflict of interest according to Section 185 of the Constitution or not?

Due to some political parties wanting to resolve the ethical issues and the power of the Constitutional Court and the NACC in adjudicating the matter, there are issues that may not directly comply with the intention of Section 185 of the 2017 Constitution, which clearly states that ‘Members of the House of Representatives or Senators shall not use their status or position as members of the House of Representatives or Senators to do anything that is in the nature of interfering or interfering (with government agencies, state agencies) for their own benefit, the benefit of others or the benefit of political parties, whether directly or indirectly.’

However, in the past, some politicians from political parties have all suffered wounds from violating the constitution. They were sentenced by the NACC and sent to the Supreme Court for punishment, or the Constitutional Court ruled to dissolve the party, causing many former politicians to be removed from their positions and leave the orbit of being a politician in large numbers. Almost all of these were the results of violating ethics. And there are still many waiting in line to be investigated and judged. Therefore, the rush of political parties and politicians to request amendments to the constitution in sections regarding ethics, without caring about the people’s livelihoods and reducing inequality, may be considered a direct violation of Section 185 of the constitution on conflicts of interest.

For this reason, the organization that loves the nation and the country must submit a complaint to the NACC to investigate and give an opinion on the case according to the NACC’s authority under the 2018 Organic Act on the Prevention and Suppression of Corruption. If the NACC decides that it falls under this category, it may have to forward the case to the Supreme Court to take legal action against the politicians who signed the draft amendment to the constitution, according to the said article. We have seen the NACC’s work on such cases in many cases already. And since political parties and politicians are about to directly interfere with the NACC’s authority, they must teach the politicians a lesson.
