Bangkok: Suchart Chomklin, Deputy Prime Minister and Minister of Natural Resources and Environment, has instructed his legal team to file a criminal lawsuit against Ice-Rakchanok for defamation. The lawsuit arises from allegations that Ice-Rakchanok posted false information accusing Suchart of becoming a minister through election fraud, with the plaintiff seeking 50 million baht in damages.
According to Thai News Agency, Suchart has authorized Dr. Nattawut Wongniem, Head of Legal Affairs, to represent him in the lawsuit filed against Ms. Rakchanok Srinok. The criminal charges involve violations of the Computer Crime Act and defamation by publication, while a civil case seeks damages for tortious acts. The Taling Chan Criminal Court has accepted the lawsuit, with a preliminary hearing set for April 27, 2026, at 1:30 PM, which Suchart plans to attend in person.
Dr. Nat explained the timing of the lawsuit, noting that the Election Commission has certified the list of proportional representation MPs. He emphasized the urgency due to the parliamentary immunity MPs receive, which restricts arrests or prosecutions during the session unless a lawsuit is already in court. The legal team has taken a proactive approach to ensure the judicial process proceeds before the parliamentary session begins.
Previously, on February 26, 2026, a complaint was filed with the Bang Phlat Police Station regarding the defamatory post. The post accused Suchart of "coming from power through election fraud," with Ms. Rakchanok commenting under a pseudonym. Although she later edited her comment, Suchart had already captured a screenshot, completing the alleged offense. Concerned about potential delays, Suchart decided to file the lawsuit personally. Dr. Nat affirmed Suchart's clean legal record, noting that he has never faced prosecution or been implicated by the National Anti-Corruption Commission or the Election Commission for election fraud.
In contrast, Ice Rakchanok's criminal history includes two cases. The first involves a prosecution under Section 112 of the Criminal Code, resulting in a six-year prison sentence currently under appeal. The second case, filed by Suchart at the Ratchada Criminal Court, pertains to the Skyy9 building issue, with the court awaiting witness testimonies. Suchart has requested the Taling Chan Criminal Court to consider adding the sentences from these cases to the current one.
The civil lawsuit, linked to the criminal case, seeks 50 million baht in damages under Section 420 and Section 423 of the Civil and Commercial Code, plus 5% annual interest as stipulated by law.
Dr. Nat asserted that the evidence is clear and sufficient for a conviction. Ms. Rakchanok allegedly used her Facebook page for political communication, posting accusations that significantly affected Suchart. Despite the police report, she continued to post content seemingly intended to prevent her ministerial appointment by Mr. Anutin. The legal team is exploring further charges and considering filing a direct lawsuit.
Dr. Nat clarified that the lawsuit is not a politically motivated SLAPP but rather a legitimate exercise of legal rights. Evidence has been compiled and submitted to the court, which will be disclosed at the preliminary hearing on April 27th.
