Bangkok: Cheers erupted as the government announced an increase in compensation for victims of criminal cases and defendants who are acquitted, with compensation now reaching up to 300,000 baht. This change is effective immediately.
According to Thai News Agency, Ms. Lalida Periswiwatana, Deputy Spokesperson for the Prime Minister's Office, disclosed that a ministerial regulation has been published in the Royal Gazette under the Act on Compensation for Victims and Compensation and Expenses for Defendants in Criminal Cases, B.E. 2544 (2001). This regulation, which will be implemented from March 3, 2026, aims to adjust compensation rates in line with current economic and social conditions.
The deputy spokesperson highlighted that this amendment seeks to bolster citizens' rights protection, ensuring both victims in criminal cases and acquitted defendants receive more suitable compensation. Notably, the compensation ceiling for victims has increased substantially. In cases of victim death, compensation now ranges up to a maximum of 300,000 baht, inclusive of all related expenses.
For non-fatal incidents, the updated regulation provides for a maximum of 80,000 baht in medical expenses, up to 50,000 baht for physical and mental rehabilitation, and a maximum of 100,000 baht for other damages. Additionally, the regulation sets a new compensation rate of up to 300,000 baht for loss of limbs or disability. Defendants wronged by legal proceedings also see increased protections.
For defendants who die due to legal proceedings, the maximum compensation is 300,000 baht. For surviving defendants, medical expenses are capped at 80,000 baht, rehabilitation expenses at 50,000 baht, and legal proceedings expenses at 30,000 baht.
Ms. Lalida emphasized that these measures aim to ensure fairer assistance, reflect actual damages, streamline procedures, and enhance the efficiency of the compensation review process, enabling swift and effective compensation for those affected.
