Bangkok: The People's Democratic Reform Committee (PDRC) is eagerly awaiting the court's decision on whether the February 8th election will be declared invalid.
According to Thai News Agency, Mr. Teera Sutheewarangkoon, from the People's Party (PPP), disclosed the party's strategy in response to the potential annulment of the election. The legitimacy of the February 8, 2026 election has been submitted to the Constitutional Court for evaluation, with concerns raised about the barcode-based ballots and their impact on election secrecy.
The PPP is closely monitoring the situation to see if the court will annul the entire election. Should a new election be ordered, the People's Party is prepared to present candidates once more. Mr. Teera mentioned that if the court finds the election unconstitutional, the Election Commission would be required to organize a new election using its legal authority, without necessitating a new royal decree.
The potential legal repercussions for the Election Commission are also under consideration. If both the Administrative Court and the Constitutional Court determine the election was unconstitutional due to the Commission's actions, the issue would proceed to ordinary courts. The courts would then assess whether any flaws in election management were intentional or due to negligence.
The possibility of the Election Commission being held criminally liable remains uncertain, as criminal cases require proof of intent to cause damage or defraud the election. Responsibility for the election's secrecy falls under the purview of the Election Commission and its officials, with liability determined based on individual case facts.
Mr. Teera emphasized that while the party believes the Election Commission conducted the election unfairly, the court's discretion ultimately determines legal liability. The party has fulfilled its role in scrutinizing the Election Commission's election management, though there have been instances where the Constitutional Court's rulings did not result in criminal liability due to a lack of intent.
