Pheu Thai Party Candidate’s Disqualification Unlikely Despite Legal Issues

Bangkok: Somchai Srisutthiyakorn, a former member of the Election Commission, has expressed that the Pheu Thai Party's parliamentary candidates are unlikely to face disqualification in the current circumstances.

According to Thai News Agency, Somchai discussed the situation surrounding a People's Party candidate in Bangkok who is currently under an arrest warrant related to a money laundering investigation. He noted that, based on Article 50 of the Constitutional Law on the Election of Members of the House of Representatives, a candidate's registration cannot be withdrawn after completion except in cases of death, disqualification, or having prohibited characteristics. These exceptions are applicable only before the registration deadline, following a primary vote and a resolution by the party's executive committee three days before registration.

Somchai further emphasized that the Election Commission must assess whether the pending charges could lead to disqualification. He personally believes that, since the case is not resolved, the charges should not automatically result in disqualification under the current legal framework.
