Bangkok: The Supreme Administrative Court has dismissed the lawsuit filed by the Police Chief and others regarding the dismissal of "Big Jok" from service, ruling that the actions were in accordance with the law and regulations of the Police Commission. The court stated that the plaintiff was a suspect in a serious criminal case and therefore the order was justified.
According to Thai News Agency, the Supreme Administrative Court convened to hear the case in which Pol. Gen. Surachet Hakpal, former Deputy National Police Chief, as the plaintiff, sued defendants 1-3: the National Police Chief, the Police Civil Service Ethics Committee, and the Prime Minister. The plaintiff requested the court to overturn the defendants' orders. After reviewing the evidence and legal arguments, the Supreme Administrative Court dismissed the case against defendants 1-3 regarding their orders to suspend Pol. Gen. Surachet Hakpal from duty.
The court stated that the Police Chief's order was in accordance with the law and regulations of the Police Commission, which granted him the authority to consider the matter. This was based on the fact that the plaintiff was a high-ranking police officer accused of serious charges, leading to an arrest warrant being issued by the Criminal Court, and that the offense was not due to negligence. Therefore, the order issued by Pol. Gen. Kittirat Panpetch, the acting Police Chief, was lawful and within his legal authority.
Furthermore, the order to dismiss Pol. Gen. Surachet from service did not immediately result in Pol. Gen. Kittirat, who was acting Commissioner General of Police at the time, being selected. The selection process still required consideration of knowledge, ability, qualifications, and conduct by the National Police Commission. Therefore, it was not an impartial order; it was issued in good faith and in accordance with the law.
The Administrative Court has therefore ordered the dismissal of the case against the Police Chief and the three others.
